1. TESTING AND RATING PRODUCTS

Platinum Billiards Inc. is an independent company and has no affiliation with any Billiard Product manufacturer.

The performance information we provide is based on careful scientific testing and observation. We are highly experienced at testing the performance of cues and we believe that our methods are sound and accurate; however, we do not claim that our findings are absolute. We are aware that cues of a same model vary slightly and as we test more samples of each, the numbers will become more refined. If any manufacturer is unhappy with our results and/or feels that the ratings are unfair, we encourage them to contact us and we will be happy to answer questions about our methodology and/or arrange for the testing of any cues they would like to send us, and if warranted, we will adjust the numbers accordingly.

In no event shall Platinum Billiards Inc. be liable for any special, consequential, indirect, exemplary or punitive damages whatsoever, including but not limited to lost revenue or profits, loss of business or loss of business opportunity, whether or not Platinum Billiards Inc. has been advised of the possibility of such damages, arising from these testing procedures and the publication and interpretation of test results and ratings.

2. WARRANTY DISCLAIMER

Limited and express warranties made by manufacturers, if any, are included in the documentation accompanying product purchases. Graphics and other descriptions of products have been provided by manufacturers and distributors, and Platinum Billiards Inc. makes no representation as to their accuracy or completeness. Colors and features may vary. Platinum Billiards Inc. makes no warranty as to goods or services other than as may be provided by the manufacturer. All other warranties of any nature, express or implied, including warranties of merchantability and fitness for a particular purpose, are hereby disclaimed.

3. LIMITATION OF LIABILITY

In no event shall Platinum Billiards Inc. be liable for any special, consequential, in direct, exemplary or punitive damages whatsoever, including but not limited to lost revenue or profits, loss of business or loss of business opportunity, whether or not Platinum Billiards Inc. has been advised of the possibility of such damages. Platinum Billiards' liability shall be limited to repair or replacement, in the sole discretion of Platinum Billiards Inc., of any product. Customer agrees that in no event shall liability of Platinum Billiards Inc. exceed the purchase price paid by customer.

4. CHOICE OF LAW; CONSENT TO JURISDICTION; ATTORNEYS' FEES

Customer agrees that this Agreement shall be governed and interpreted in accordance with Florida law without regard to conflicts of laws rules. The parties agree that the state or federal courts of Florida of competent jurisdiction shall have exclusive jurisdiction to resolve any claim or action arising out of or in connection with customer's purchase from Platinum Billiards Inc. and this Agreement, and that all such actions shall be adjudicated in Jacksonville, Florida. Customer consents to the personal jurisdiction of the courts of Florida for such purpose, and agrees it will not contest venue as appropriate in Jacksonville, Florida. The parties waive right to trial by jury. Platinum Billiards Inc. shall be entitled to recover its reasonable attorneys' fees and costs of enforcement of this Agreement.

Exclusive Agreement

This Agreement represents the entire agreement between customer and Platinum Billiards Inc. with respect to its subject matter, subject only to the credit agreement, if any, between customer and Platinum Billiards Inc. and the invoice descriptions of goods, pricing and quantity. These terms are subject to change by Platinum Billiards Inc. at any time without prior notice. Terms of customer's purchase orders, offers or other terms and conditions are void and without effect. In the event that any provision of this Agreement is found unenforceable, the remaining provisions shall not be affected and shall continue in full force and effect. No failure by Platinum Billiards Inc. to exercise any remedy for breach shall operate as a waiver of any other right or subsequent breach. Headings are for convenience only, and shall not affect the enforcement of any provision.

Export

Customer warrants that it is in compliance with all United States and state regulations governing receipt of products, and will comply with all United States regulations governing export and re-export of products, and is solely responsible therefore.

Prices and Quotes

Quotes are valid for the time period stated therein. Platinum Billiards products and pricing and item availability are subject to change at any time without notice. We reserve the right to limit quantities on certain items. Platinum Billiards Inc. will attempt to procure any available product for you, but is not liable for changes in models or features or lack of availability of any particular product at any particular time.

Platinum Billiards Inc. updates its site frequently, and every effort is made to provide and display up-to-date and accurate information. However, we reserve the right to cancel any order due to incorrect pricing or other terms displayed. In this event, we will work with you to find the best available product in your price range, and issue an immediate credit to you on any pre-paid order.

Acceptance; Payment Terms; Shipment

Orders are not binding until accepted by Platinum Billiards Inc. Payment terms are in the sole discretion of Platinum Billiards Inc. Unless otherwise provided in any separate credit agreement between customer and Platinum Billiards Inc., all orders must be prepaid by credit card, wire transfer or as otherwise provided on this site. Invoices are due and payable as provided therein. Parts of orders may be invoiced and shipped separately. Customer agrees to pay interest on any unpaid invoice in the amount of 1 1/2% per month, or the highest rate provided by law.

Shipment dates are approximate, and Platinum Billiards Inc. shall not be liable for any delay in shipment. Shipping charges are noted on your invoice.

Force Majeure

Platinum Billiards Inc. will attempt to give you notice of any changes or delays to your order, but is not liable for damages resulting from delays beyond its reasonable control.
